INHERENT RIGHT OF SELF-DEFENCE IN RUSSIA – UKRAINE CONFLICT

The Inherent right of self-defense under Article 51 of the United Nations Charter has been invoked by the Russian side as part of the basis for its "special military operation" to be conducted in Ukraine from February 24, 2022. However, the theoretical application of the right to just self-defense remains a matter of controversy, especially in the way it is described and interpreted as a means of legitimizing the use of force. The following study will examine the correctness of Russia's claim on the right of self-defense to make comments and assessments about the event while giving some recommendations to the stakeholders. Foreigners will contact and draw experience from Vietnam to avoid similar problems.
