Tài nguyên giáo dục mở (OER) và khóa học trực tuyến đại chúng mở (MOOCs) được kỳ vọng mở rộng tiếp cận giáo dục chất lượng cao, song bản chất “mở” theo khung 5R xung đột trực tiếp với hệ thống bản quyền truyền thống. Bài báo phân tích các điểm xung đột về 5R, khả năng tiếp cận, sở hữu trí tuệ và rủi ro sử dụng học liệu sau khi tác giả qua đời. Trên cơ sở năm vụ việc điển hình quốc tế (thỏa thuận edX-DOJ 2015, chuỗi kiện Jason Camacho, Post University kiện Learneo, Hachette kiện Internet Archive và vụ Concordia) - được chọn theo tiêu chí liên quan OER/MOOCs, có phán quyết hoặc thỏa thuận chính thức và phản ánh xung đột bản quyền hoặc khả năng tiếp cận - bài báo chỉ ra rủi ro pháp lý, chi phí tuân thủ và hiệu ứng “lạnh”. Trong bối cảnh Việt Nam thực thi Luật Sở hữu trí tuệ 2025, Nghị định 341/2025/NĐ-CP, Quyết định 1117/QĐ-TTg (2023) và Thông tư 61/2026/TT-BGDĐT, bài báo đề xuất khung chính sách cân bằng nhằm bảo vệ người học, khuyến khích sáng tạo bền vững và đảm bảo chất lượng nguồn nhân lực trong chuyển đổi số giáo dục.
